What information do we collect?

We only collect personal information that is necessary for us to conduct our business, to develop and promote our services and to assist us with complying with our own legal and regulatory obligations. We may, for example, keep a record of your name, date of birth, medical conditions that you disclose to us, occupation, address, telephone numbers, e-mail address, social media addresses, banking details and interests.

These may include, for example, delivery organisations, third party suppliers and agents. Cookies are small pieces of information that are stored by your browser in your computer’s memory and they are used to record how you navigate our website on each visit. Cookies that are used in any part of our website will not be utilised for collecting personally identifiable information and will only be used for internal management purposes. Terms & conditions

These terms set out the terms and conditions that apply whenever you attend a class at Yoga by Kajsa, purchase a package or membership with us, or browse, access or log into our Online Studio.  By purchasing a membership or package, attending any class, or browsing, accessing or logging into our Online Studio, you acknowledge and agree that you have read, understood and accept all of the terms and conditions set out below.

Introductory Offer

  1. Any introductory offer made by Yoga by Kajsa may only be used by new members who have not yet attended any classes.

  2. Introductory Offers will be valid for a specified term, usually expressed in days. The term of the Introductory Offer will start on the date that you first attend a class after signing up for the offer or on the first date that you are granted access to our Online Studio (whichever is earlier).

  3. Our Introductory Offer allows you to access an unlimited number of regularly scheduled classes during the term of the offer, but excludes guest teachers, workshops, packages or other special events.  It also allows you to access the on demand library during the period of the Introductory Offer.

  4. No refunds, transfers, suspensions or extensions are offered on unused portions of any Introductory Offer due to illness, injury, or any other reason unless you have a medical certificate from a medical practitioner.

Weekly membership

  1. The term of the Weekly Membership commences on the date that you purchase the membership or such other date as is agreed by Yoga by Kajsa.

  2. This membership allows you to attend an unlimited number of regularly scheduled online live classes on a weekly basis and unlimited access to the on demand online class library during the term of your membership, but excludes guest teachers, workshops, packages, or other special events. Please also note that, during any period where your membership is suspended, your access to the Online demand library will automatically be suspended too.

  3. The membership will continue indefinitely until you request a termination of your membership using the online cancellation form. Please note that all requests for termination must be submitted using this online form and must be made in accordance with the termination policy set out below.

  4. You may request a suspension of your membership using the online form, (add in a link to suspension form). Please note that all requests for suspensions must be submitted using this online form and must be made in accordance with the suspension policy set out below.

  5. Your membership will be debited on a weekly basis. You can cancel your membership at any time. No lock in contracts.

  6. Monthly Membership

  1. The term of the Monthly Membership commences on the date that you purchase the membership or such other date as is agreed by Yoga by Kajsa.

  2. This membership allows you to attend an unlimited number of regularly scheduled online live classes on a monthly basis and unlimited access to the on demand online class library during the term of your membership, but excludes guest teachers, workshops, packages, or other special events. Please also note that, during any period where your membership is suspended, your access the Online demand library will automatically be suspended too.

  3. The membership will continue indefinitely until you request a termination of your membership using the online form. Please note that all requests for termination must be submitted using this online form and must be made in accordance with the termination policy set out below.

  4. You may request a suspension of your membership using the online form. Please note that all requests for suspensions must be submitted using this online form and must be made in accordance with the suspension policy set out below.

  5. Membership fees will be charged to your credit card or bank account once a month via a third party biller.

  6. From time to time, Yoga by Kajsa may increase its fees for the Unlimited Membership. Notice of any such increase will be provided at yogabykajsa.com. Your membership fees will increase accordingly, with such increase to take effect no less than 2 weeks after the date that the increase of fees is notified on the website.

  7. It is your responsibility to ensure there are sufficient funds available to cover the auto-debit. If an auto-debit is declined due to insufficient funds or fails for any other reason, our third party biller, Stripe, applies a fee for these failed transactions, see their website terms and conditions. This fee will be debited from your account after the failed payment.

  8. In addition, if an auto-debit fails, you authorise and consent to us reprocessing the auto-debit payment after its due date for payment in order to seek to recover the full amount of the failed payment. You acknowledge that any additional fees associated with such reprocessing will be borne by you.

  9. If your credit card that you have registered against your profile expires during the period of your membership, you must update your credit card details with us to ensure that, at all times, we have details of a valid and current credit card from which to process auto-pays.

  10. Yoga by Kajsa is in no way responsible for additional bank fees that you may incur from your bank. Bank fees are under the terms and conditions of contractual agreements that lie between you and your bank.

  11. Yoga by Kajsa may at any time, and in its absolute discretion, cancel the membership, including (for instance) if your auto-debit payments fail for 2 payments or more.

  12. The terms and conditions or our third party biller Stripe form a binding component of your membership agreement. They can be found at www.yogabykajsa.com titled “Stripe Terms ”. By purchasing a Weekly or Monthly Membership, or attending any class using any one of the memberships, you are deemed to have agreed to and signed the Stripe Terms.

Webinars, short courses, packages

23.  For webinars, short courses and packages a 50% deposit is payable upon signing up. The full payment is due 14 days prior to the start of the course, package or event.

24.  Waitlist policy- In case of limited numbers to a webinar or short course we could add you to the waitlist or advise you of alternative dates. Please advise us in writing if you like to add your name to this list. If a space becomes available we will advise you immediately and full payment is required directly.

25.  Refund policy- if you withdraw or transfer from the webinar, short course or package the following applies;

1.     If you withdraw 14 days or more from your class a full refund will be given back expect the admin fee of AU$20..

2.     If you withdraw 13 days or less, the fee is non refundable

3.     If you can’t attend on the specific date a transfer to another course date could be possible with a fee of $20.

4.     If a course has been started no refunds will be given. If a student is unable to complete the course due to a serious illness they must contact Yoga by Kajsa via email info@yogabykajsa.com. Each refund is considered on a case by case basis. If the course has been paid in full, we still require the non refundable fee of $20.

26.  If you are attending  an online event it’s your responsibility to check that the internet connection works prior to commencement. No refunds are given due to failure to connect to internet.

Suspension Policy

  1. You may only suspend your Unlimited Membership in accordance with the policy set out below.

  2. Only memberships on weekly or monthly direct debit arrangements may be suspended.  Any other class passes may not be suspended, including any upfront memberships for 3 months, 6 months, 12 months or any other period.

  3. Suspension requests must be submitted using (add link to form)  at least 7 days before the suspension start date.  Each suspension must be for a period of 14 days or more, and must be for a number of whole weeks (i.e. 2 weeks, 3 weeks, etc). The maximum suspension period in any 12 month period is 12 weeks (or 84 days).

  4. Students may not suspend their membership if they have a negative account balance at the time of requesting the suspension or at the time that a suspension is scheduled to commence.  We request that students please check their account balance  and make sure that their account is up to date prior to requesting a suspension.

 

Termination Policy

  1. Your membership will continue indefinitely until you terminate it in accordance with the policy set out below.

  2. There is no minimum term for your membership.

  3. Termination requests must be submitted using this online form (add my own link) at least 7 days before the proposed termination date.

  4. We will not refund any debits that are processed in the 7 day period after a termination is requested. However, we will allow students to continue to access the studios for the relevant period relating to that debit.  For instance, if a fortnightly debit is deducted 3 days before the proposed termination date, you will continue to have access to the studios until the end of that fortnight.

  5. Students may not terminate their membership if they have a negative account balance at the time of requesting the termination or on the proposed termination date. We request that students please check their account balance and make sure that their account is up to date prior to requesting a termination.

 

Covid 19

33.  In case of Covid 19 symptoms or exposure to someone with Covid 19 symptoms, at least 24 hours notice must be given to Yoga by Kajsa in order to be eligible for a partial refund of 50%.

 

Negative account balances

  1. If, at any time, you have a negative account balance with us (i.e. following a failed auto-debit or a purchase you have otherwise made on account), you authorise and consent to us seeking to process payment of the full amount of that negative balance from time to time using the credit card or bank account details that you have registered against your account. You acknowledge that any additional fees associated with such reprocessing will be borne by you.

Filming of yoga classes

34.  You acknowledge and agree, that if you attend an in person class we may or may not film this class and upload for viewing in our on demand library/ online studio. If you are photographed or filmed during any such class, your consent and approve to us uploading the video footage to our Online Studio and using that video footage for any purpose whatsoever (including in our promotional materials and various social media accounts).

35.  We will advise you that we are filming and if you prefer, you may wish to place your mat in an area that is not captured in the video footage.

Online terms and conditions

  1. The terms on which we make available the Online Studio are available here: (add link to online terms and conditions) By logging into or accessing the Online Studio, you agree to be bound by those terms, whether you are a “Visitor“ (which means that you simply browse the Online Studio) or you are a “Member“ (which means that you have registered on the Online Studio as a user). If you do not accept these terms, you should not log into or access the Online Studio.

Booking of live class

37.  If you are going to attend our weekly online live stream class please book ahead to confirm your attendance. You will be sent a link once booking is received.

General Terms and Conditions

  1. Yoga by Kajsa is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason, or if you are unable to attend a class because it is full.

  2. If attending an online class ensure that you logon to the class 5-10 minutes prior to the advertised start time to avoid missing out of the full class.

  3. During any  classes held live in person, Yoga by Kajsa is not responsible for the safekeeping of your belongings.

  4. All purchases are final. Yoga by Kajsa does not offer refunds on services or products for change of mind, injury, illness, change of address or any other reason.

  5. All passes and memberships are non-transferable and may not be shared.

  6. There are further and more specific terms and conditions that relate to our Introductory Offers and Memberships. Those further terms are set out above.

  1. Students are eligible for a full refund when Yoga by Kajsa has to cancel the course, webinar or workshop due to low enrolment, or unforeseen circumstances. Yoga by Kajsa will refund the student the course fee including the deposit fee.

  2. By attending classes at Yoga by Kajsa, you confirm your understanding that classes at Yoga by Kajsa may be physically strenuous, and you voluntarily participate in them with full knowledge that there is possible risk of personal injury, property damage or death.  If any medical history or doubt if yoga is ok for you, please consult with your medical practitioner and advise Yoga by Kajsa prior to commencement of class. You also agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Yoga by Kajsa or its directors, officers, employees, consultants or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
